Benjamin Franklin observed that "Laws too gentle are seldom obeyed; too severe, seldom executed." Whatever implications Franklin may have intended, there are definitely ramifications of abuse, on the one hand, and mercy, on the other. Either exceeds the law, but in opposite directions. We are perhaps more familiar with abuse than mercy. It is too much to say that, if it were not for abuse, it would not be necessary to have laws in the first place; because there must be parameters in order to know what constitutes a violation.
